Terms and Conditions
1. Scope of Application and Contractual Basis
1.1 These General Terms and Conditions apply to package travel contracts between the client and:
The Mystical Land
A ‘Royal India UG’ brand

1.2 They govern the booking and execution of travel packages to India, consisting of at least two travel services (e.g., transport, accommodation, tour guides), offered by the Organizer(The Mystical Land) as a package tour under §651a BGB (German Civil Code).
2. Conclusion of the Travel Contract
2.1 By submitting a booking acceptance (online or in writing), the client offers to conclude a binding travel contract.
2.2 The contract is concluded upon receipt of the booking confirmation and/or travel confirmation from the Organizer. Booking confirmation is the document issued by the Organizer after accepting the Client’s booking request, confirming basic contract details such as package components, dates, prices, and payment terms. The Travel confirmation is the detailed, tailor-made itinerary sent after the Booking Confirmation, outlining the daily schedule, accommodations, transport, and other specific services.
2.3 The confirmation is sent via email unless otherwise agreed.
2.4 Once the contract is concluded, any requests for modifications are not guaranteed and may only be considered subject to availability.
3. Payment
3.1 A deposit of 50% of the total travel price is due within 5 business days after receipt of the booking confirmation and the legally required travel security certificate (§651r BGB).
3.2 The remaining balance is due 30 days before departure.
3.3 In case of short-notice bookings (less than 30 days before departure), the full price is due immediately upon booking.
3.4 Two invoices will be generated and issued to the customer at the time of booking: one for the deposit and one for the remaining balance.
3.5 Payments must be made to the bank account provided in the invoice.
3.6 If payment is not made on time, we reserve the right to withdraw from the contract and charge cancellation fees. For details on the calculation of the cancellation amount, please refer to Section 6.
4. Services
4.1 The scope of services is based on the booking confirmation and the description in the offer valid at the time of booking.
4.2 Changes to services before contract conclusion may occur for valid reasons (e.g., change in regulations or availability). Client will be informed before booking.
5. Changes to Services and Prices After Booking Confirmation
5.1 Changes to Services
5.1.1 The scope of services is defined by the booking confirmation and the travel confirmation valid at the time of booking.
5.1.2 Despite thorough planning, changes to individual travel services may be required after booking confirmation due to circumstances beyond the Organizer’s control. Such changes may be caused by:

Adjustments in domestic or regional flight times and routes

Reassignment to hotels of the same or higher category

Substitution of sightseeing points due to unforeseen closures (e.g., holidays or maintenance)

Modifications to internal transportation arrangements or schedules

Replacement of guides or tour leaders

Alterations to meal plans based on availability

5.1.3 In the event of a significant change to an essential service, the Client will be informed without delay. Efforts will be made to provide a comparable or improved alternative, ensuring that the overall character and quality of the trip are preserved.
5.1.4 If the proposed change is not accepted by the Client, suitable alternatives will be sought in close consultation. Should no mutually agreeable solution be found, the options available under §651g BGB may then be considered.
5.2 Changes to Prices
5.2.1 Adjustments to the travel price may be applied after booking confirmation only under conditions permitted by law. Such adjustments may result from:

Revisions to taxes, airport or port charges, or government-imposed levies

Introduction or increase of entry fees, tolls, or official charges in the destination country

5.2.2 In the case of a price increase, written notification including clear justification will be provided to the Client. In such cases, suitable alternatives will be offered where possible, or adjustments will be made to preserve the original value of the trip.
5.2.3 All reasonable efforts will be made to address the Client’s expectations while complying with legal obligations and ensuring transparency.
6. Cancellation by client
6.1 Customers may cancel the trip at any time before departure. Cancellation must be submitted in text form (email or letter).
6.2 The following cancellation fees apply, unless otherwise stated:

6.2.1 60 days or more before departure: 90% refund of travel prices

6.2.2 37–59 days: 75% refund

6.2.3 16–36 days: 50% refund

6.2.4 8–15 days: 25% refund

6.2.5 0–7 days (or no-show): No refund

6.2.6 60 days or more before departure: 75% refund of travel price

6.2.7 45–59 days: 50% refund

6.2.8 30–44 days: 25% refund

6.2.9 15–29 days: 10% refund

Ayurveda:

6.2.11 The cancellation policy depends on the specific Ayurveda partner and various other factors. The exact cancellation policy will be provided during the booking process

6.3 The customer may prove that lower or no damages occurred.
6.4 Travel insurance (especially cancellation and medical insurance) is strongly recommended.
7. Rebooking and Substitute Travelers
7.1 Rebookings (e.g., change of date or destination) are possible up to 31 days before departure for a processing fee of €100 per person.
7.2 Within 30 days, a rebooking is only possible via cancellation and new booking.
7.3 No substitute travelers are allowed. All bookings are non-transferable and tied to the original traveler’s name and passport details.
8. Passport, Visa, and Health Requirements
8.1 Customers are responsible for complying with all passport, visa, and health requirements for entry into India.
8.2 We provide general information at the time of booking, but travelers must verify requirements with official authorities (e.g., Indian Embassy or consulate).
8.3 For German citizens, a valid passport and electronic visa (e-Visa) are typically required.
8.4 Vaccinations may be recommended or required (e.g., COVID-19, hepatitis, typhoid). Travelers should consult a travel medicine expert.
9. Liability of the Organizer
9.1 Liability shall be assumed for the proper provision of all booked travel services.
9.2 Within the scope of the legal duty of care, liability shall be assumed for the conscientious preparation of the trip, the careful selection and monitoring of service providers, the accuracy of the service description, and the proper provision of the agreed travel services.
9.3 Liability for damages that do not involve personal injury shall only be assumed in cases of intent or gross negligence.
9.4 No liability shall be assumed for disruptions caused by third parties who are not involved in providing the travel services, nor for events of force majeure.
10. Limitation of Liability for Luggage
10.1 Loss, damage, or delay of luggage during flights must be reported immediately to the airline and documented via a Property Irregularity Report (PIR).
10.2 The Organizer is not liable unless the airline fails to compensate and we are at fault.
11. Duties of the Traveler
11.1 Customers must report any travel deficiencies immediately to the local tour representative or the Organizer.
11.2 If the customer does not report an issue, they may forfeit their right to a reduction or compensation (§651o BGB).
11.3 In case of serious defects, the customer may set a remedy deadline and, if unfulfilled, cancel the contract.
12. Insurance
12.1 We strongly recommend taking out:

12.2 These can be suggested by The Mystical Land and can only be offered by third-party providers.
13. Data Protection
13.1 Personal data is collected and processed only to the extent necessary for performing the contract.

14. Applicable Law and Jurisdiction
14.1 German law applies to the contractual relationship.
14.2 If the customer is a merchant or has no residence within the EU, the place of jurisdiction is Berlin, Germany.
14.3 Otherwise, the statutory jurisdiction applies.
15. Severability Clause
15.1 If any provision of these terms is or becomes invalid, the remainder of the agreement remains effective.
